It is deemed mandatory that all businesses, e-commerce sites, shops, stores and showrooms etc have an established set of rules and guidelines for them to work properly and efficiently. This set of rules and procedures to follow should be available and accessible in all mediums, i.e. electronic, hard copy etc. This document detailing the rules and provisions laid down for doing business by an organisation, business entity or shop is called the ‘Terms and Conditions of that business organisation or entity.
It also acts as a valid agreement between the seller, the service provider and the buyer. Therefore it is very important to have a very clear-cut ‘Terms and Conditions Policy for businesses who are dealing in gemstones and jewellery items also. Let’s now see what are the important aspects of the ‘Terms and Conditions Policy as this is a legal binding document between a seller of goods and services and the buyer.
- Applicable Laws: By this, it is meant here that the business entity and the purchaser/buyer has to follow and abide by all statute, law, ordinance, notification, rule, regulation, judgement, order, decree, approval, directive, guideline and policy as put in effect by the government.
- Goods: Here the definition of the word ‘Goods’ means any article, that is tangible or intangible like software technology, license, patents or any intellectual properties being offered for sale. This is also applicable to the sale of tangible articles like electronic items, automobiles, clothes and apparel and especially jewellery items. Since we are dealing in Gemstones, therefore here it means any gemstone article, product or jewellery items etc. The term ‘Goods’ is also applicable where transportation and delivery, insurance, warranty obligations etc are defined under the scope of supply in a Contract.
- Services: Services here means the supply of products and services offered by the seller as mentioned in the Contract. In our context, it refers to the kinds of astrological consultancy services we are providing to our clients based on their requirements.
- Service Level Agreement: This is a very important document as it defines and lays down the Contractual commitment that takes between the seller and the buyer concerning the type of service or good being offered by the seller. This document also depends on factors like desired performance, reliability level, the responsiveness of the seller and the time frame of resolutions provided by the seller etc.
- Specifications according to Categories: This is another important feature of this document. Here we can define our products and services according to the qualities, features, certifications and purposes of each product and service offered to the customer. This includes the key parameters defining the products and all the necessary validations related to configurations, type of product etc. It is important to note here that sellers as well as buyers shall have to abide by these validation rules, restrictions etc while buying or selling any good or service as laid down in the Category Specification List.
- Provision of User Id and Password: It is mandatory to have a user id and a password for all sellers and buyers after registering themselves on the website. It is also the sole responsibility of the owner of the user id and password to keep the information confidential.
- License: This is legal permission granted by the government to any seller of goods and services to sell or offer goods and services to a buyer or a purchaser. This document is legal and irrevocable and is only given after a business entity registers itself on the government‘s portal.
- Eligibility: Eligibility to enter into an agreement or a contract between the seller and the buyer is determined by a few factors like past performance, profitability guidelines, laws etc.
